Welcome to darcywintermusic.com (the “Site”). The Site is operated by Darcy Winter Music (“we”, “us”, “our”), based in London, United Kingdom.

By using the Site you agree to these Terms of Use. If you don’t agree with them, please don’t use the Site.

1. About these terms

These terms govern your use of the Site only. If you buy something, book a ticket, or submit music through a third-party platform we link to, that transaction is governed by that platform’s own terms, not these.

We may update these terms from time to time. The version published on this page is the one that applies. We’ll update the “last updated” date whenever we make changes, and material changes will be flagged on the Site.

2. Using the Site

You may view, download and print pages from the Site for your own personal, non-commercial use.

You must not:

  • use the Site in any unlawful or fraudulent way, or for any unlawful or fraudulent purpose

  • copy, reproduce, republish, sell, rent, sub-license or commercially exploit any material from the Site without our written permission

  • systematically extract or scrape data from the Site, including for the purpose of training machine learning or AI models

  • attempt to gain unauthorised access to the Site, its server, or any connected database

  • introduce viruses, trojans, worms, or any other malicious or technologically harmful material

  • use the Site in any way that could damage, disable, overburden or impair it, or interfere with anyone else’s use of it

We may suspend or withdraw your access to the Site if you breach these terms.

3. Intellectual property

All content on the Site, including recordings, compositions, lyrics, photographs, video, artwork, logos, branding and written copy, is owned by us or our licensors and is protected by copyright, trade mark and other intellectual property laws.

Nothing on the Site grants you any licence to use our music, name, likeness or branding. In particular, you may not:

  • use our recordings or compositions in videos, advertising, podcasts, or any other content without a licence

  • use our name, artist name, or logos in a way that suggests endorsement, affiliation or partnership

  • create merchandise, artwork or derivative works based on our content

Sharing links to the Site, and sharing our content through the official share functions on streaming and social platforms, is welcome and encouraged.

4. Links to other websites

The Site contains links to third-party websites and platforms, including Bandcamp, streaming services, ticketing platforms and social media. Merchandise and music listed on the Site are sold through Bandcamp — we don’t sell anything directly through this Site, and any purchase you make is a contract between you and that platform.

We don’t control those sites and aren’t responsible for their content, their terms, their privacy practices, or anything you buy through them. Links are provided for convenience only and don’t imply endorsement.

5. Mailing list

If you sign up to our mailing list, you’ll receive occasional emails about releases, shows and projects. You can unsubscribe at any time using the link in any email, or by emailing darcy@darcywintermusic.com. 6. Submissions and applications to perform

If you send us material through the Site, including music, links, images, biographies or applications to play, you confirm that:

  • you own it, or have all the rights and permissions needed to send it to us

  • it doesn’t infringe anyone else’s rights and isn’t unlawful, defamatory or offensive

You keep ownership of anything you send us. By sending it, you give us permission to listen to, view, store and share it internally for the purpose of considering it, and, if we book or feature you, to use reasonable extracts and images to promote the event or feature.

We receive a lot of material and can’t guarantee a response, can’t return anything sent to us, and aren’t responsible for material that’s lost or damaged. Please don’t send us confidential or unreleased material you wouldn’t want us to hear.

We’re not obliged to enter into any agreement with you as a result of a submission, and we’re not liable if we later independently create or release something similar.

7. Live events

Information about live events on the Site,  including dates, venues, line-ups and prices, is provided in good faith but may change. Tickets are sold by third-party ticketing platforms and are subject to those platforms’ terms and refund policies, and to the terms and conditions of the venue.

8. Accuracy and availability

We try to keep the Site accurate and up to date, but we don’t guarantee that the content is complete, current or error-free. Content on the Site is provided for general information only and isn’t advice you should rely on.

The Site is provided free of charge. We don’t guarantee that it will always be available or uninterrupted, and we may suspend, withdraw or change any part of it without notice.

9. Our liability

Nothing in these terms limits or excludes our liability for:

  • death or personal injury caused by our negligence

  • fraud or fraudulent misrepresentation

  • any other liability that cannot be limited or excluded under English law

Subject to that, and to the extent permitted by law, we exclude all implied conditions, warranties and terms relating to the Site, and we won’t be liable for any loss of profits, loss of business, business interruption, loss of anticipated savings, or any indirect or consequential loss arising from your use of the Site or of any site linked to it.

If you’re a consumer, nothing in these terms affects your statutory rights.

10. Governing law

These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you’re a consumer resident elsewhere in the UK, you may also bring proceedings in your home nation’s courts.
